By using this website and/or purchasing this device, you are agreeing to the following Terms and Conditions for its sale and use. These terms and conditions, or any part of them, may be terminated or changed by Cal Mag Fix without notice at any time, for any reason. The provisions relating to Limitation of Liability, Jurisdiction and Venue, Informed Consent and Release of Liability, and Indemnification shall survive any termination. Any updates to the Terms and Conditions will be posted on this website.

Cal Mag Fix may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Cal Mag Fix.

We offer a limited lifetime warranty for The Cal Mag Fix. device. Please see our return policy for more information. This warranty covers the mechanical functioning of the device only, it does not apply to its suitability for use for compliance in any jurisdiction.

For California Customers, we do not permit sales to those younger than 21 years old through this website. Any attempt to evade or otherwise purchase the device without fully completing the identity verification during check out is a violation of these Terms and Conditions and may be viewed as theft by Cal Mag Fix. This verification process requires you to agree that you have read and understood a statement as described in and required by California Civil Code section 3273.51. Do not proceed with the purchase if you have not read and understood that statement.

The plug for the magazine catch, which comes with the kit, must be installed per the installation instructions on this website.

This device is not recommended for New York or for jurisdictions that have laws with language similar to that found in NY’s Safe Act.

In regulated/restricted jurisdictions, if the Cal Mag Fix is installed on a regulated firearm, the Cal Mag Fix device must be engaged with the modified magazine catch provided before the action may be closed as required by law and shown on this website. In these jurisdictions, you are not to close the action of any rifle that the Cal Mag Fix is installed on without the device being engaged with the modified magazine catch provided, whether a magazine is installed or not. Doing so would be a violation of these Terms and Conditions and the law in such jurisdictions.

Cal Mag Fix has not made any claim that this device is approved for use in any jurisdiction. This is not possible to do as no official body exists that approves these types of devices. It is your responsibility to determine this device’s suitability for complying with the laws in your jurisdiction.

In an attempt to provide a better experience to our site’s visitors and/or comply with various laws, the Cal Mag Fix website may link to sites operated by third parties. In the event that a Cal Mag Fix product is mistakenly listed at an incorrect price, Cal Mag Fix reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Cal Mag Fix reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Cal Mag Fix shall issue a credit to your credit card account in the amount of the incorrect price.

jurisdiction and venue

You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of the manufacturer/company products) shall be in the state or federal courts located in San Diego County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of our products) must be commenced within one (1) year after the claim or cause of action arises. Our failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions.

indemnification

You agree to indemnify, defend, and hold harmless Cal Mag Fix, its owners, officers, directors, employees, agents, licensor(s) and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your use of this website.

limitation of liability

Cal Mag Fix shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Cal Mag Fix has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

informed consent and release of liability

You, the purchaser of The Cal Mag Fix device, hereby accept and assume full responsibility for these risks and you agree that Cal Mag Fix shall not be liable or responsible for any legal injuries to me or any incarceration resulting from my use of the The Cal Mag Fix device.

You understand that the California, Illinois, New York and other states’ legislatures have laws mandating registration and serialization of all assault weapons. The Cal Mag Fix device does not preclude or avoid this.

You agree that these laws will require that all assault weapons owners register and serialize their firearms with the DOJ or state law enforcement, to include AR-15 and AR-10 firearms with a fixed or detachable magazines. The registration shall contain a description of the firearm that identifies it uniquely, including all identification marks, the full name, address, date of birth, and thumbprint of the owner, and any other information that the department may deem appropriate.

You fully understand and agree that The Cal Mag Fix device is not intended for ghost gun builds or assault weapon conversion into a non-compliant configuration. You do not intend and will never use The Cal Mag Fix device for these or any other unlawful purposes.

You expressly release and discharge Cal Mag Fix and all its owners, parent companies, affiliates, managers, officers, directors, shareholders, partners, representatives and their principals, employees, agents and assigns of Cal Mag Fix from all claims, actions, and judgments which you or your heirs, executors, administrators and assigns may have or claim to have against any of the Indemnities, for all injuries or other damage which may result from my use of the The Cal Mag Fix device. This release shall be binding upon your heirs, executors, administrators, assigns and yourself.

You hereby acknowledge that Cal Mag Fix recommends that I consult my local and state police before installing and using the Cal Mag Fix product on my firearm(s).

You understand there are certain risks inherent in using a product such as The Cal Mag Fix , as it is not officially approved within any state or jurisdiction.

You also understand there exists the possibility of being arrested by local or state police with this product on my firearm. You also understand you may potentially be prosecuted and your firearms confiscated.

You hereby acknowledge that any cartridge malfunctions misfires, jams, misfeeds, stovepipes and any other firing malfunctions need to be cleared by a certified firearms gunsmith/armorer. You agree not to attempt to clear a misfire, cartridge jam, stovepipe or any other malfunction by other means. If you attempt to clear any firing malfunctions, you absolve Cal Mag Fix of all responsibility of personal injury to any and all parties.

You hereby agree that you will install The Cal Mag Fix device to the specifications directed by the instructions and will keep the supplied plug for the modified magazine catch provided on the product at all times, thus ensuring the magazine cannot be removed from the firearm until the action of the rifle is disassembled.

You hereby agree that you will use the product for its intended purposes without physical modification to the product or outside the standard method of operation found in the instructions for installation and use. You understand that if you operate this product outside the standard method of operation, your rifle may no longer be in compliance with state and local laws and regulations, thus exposing you to potential legal action.

You hereby understand compliance with state and local laws and regulations rely on the end users’ ability to utilize this product in the fashion it is intended. Modifications to the product or standard method of operation may cause you rifle to no longer be in compliance and you could risk arrest. Additionally, unsafe and unintended methods of operation of the firearm may also cause noncompliance. Always use the firearm and The Cal Mag Fix device as designed, engineered and intended for use.

You understand that if you operate this product outside the operating methods outlined on this website, risk of harm or death may occur.

You understand to NEVER attempt to cycle the bolt carrier group (manually or otherwise) or fire a round with the action open (receivers separated), as this may cause serious injury or death AND potentially make my rifle noncompliant with laws and regulations. Operation of an AR style firearms without the receivers/action fully closed may result in serious injuries or death.

You agree that you have read the Terms and Conditions, and understand all of its requirements of you, as well as the terms for you using The Cal Mag Fix device. You agree to this voluntarily and with full knowledge of its significance.
